Welcome to Townsville Kart Centre (TKC). By accessing or purchasing from our website, booking coaching, or joining our programs, you agree to these Terms & Conditions.

1. Definitions

• “We/Us/TKC” means Townsville Kart Centre.
• “You/Customer” means the purchaser or user of our site, products, or services.
• “Goods” means physical products we sell (e.g., parts, tyres, apparel).
• “Services” means coaching, mentoring, subscriptions, race-day support, and related programs.
• “Subscriptions/Programs” means ongoing monthly or prepaid plans (Local/Regional tiers, Season packages).
• “Site” means our website and e-commerce store.

2. Using the Site

You must be at least 18 or have parent/guardian consent to buy or enter into our programs. You agree not to misuse the Site, interfere with security, or attempt unauthorised access.

3. Prices, GST & Errors

All prices are in AUD and GST-inclusive unless stated. We may update prices at any time. If we identify an error (pricing, description, availability), we may cancel or amend an order and will promptly refund any amounts you’ve paid for items not supplied.

4. Orders & Acceptance

Your order is an offer to purchase. We accept when we dispatch the goods or confirm a service booking. We may cancel an order (with a refund) if items are unavailable, there’s a pricing error, suspected fraud, or we can’t verify payment.

5. Shipping, Pickup & Delivery

Shipping is calculated at checkout and added before payment. Pickups are by appointment/confirmation only; track-side pickup is subject to event confirmation. Timeframes and process are explained on our Shipping & Payments page (incorporated by reference).

6. Subscriptions & Programs

• Billing: Subscriptions are billed monthly to your saved card via Lightspeed Payments.
• Month-to-Month: cancel any time with 30 days’ notice (current billing month runs to end).
• Prepaid (6/12 months): discounted, non-refundable, one-time transfer to another driver permitted.
• Premium events (e.g., AKC/State Cup) are billed at casual rates unless your plan explicitly includes them.
• Rollover/credits: where offered, credit caps/expiry will be stated on the program page or checkout.
  We may change program inclusions or pricing with reasonable notice; you can cancel before changes take effect if you don’t agree.

7. Returns, Warranty & Australian Consumer Law

Our Returns & Warranty Policy forms part of these Terms. You have rights under the Australian Consumer Law (ACL). For change-of-mind timelines, exclusions, faulty/DOA process, and refunds, see that policy. Manufacturer warranties apply to eligible items; proof of purchase is required.

8. Coaching, Motorsport & Safety

Karting is a motorsport and inherently carries risk. By participating in our Services (practice, coaching, race-day mentoring), you acknowledge and accept those risks and agree to:

• Comply with Karting Australia rules and directions from officials and TKC staff.
• Use approved safety equipment and maintain your kart in safe working order.
• Ensure minors have parent/guardian consent and are supervised.
  To the maximum extent permitted by law, you release and indemnify TKC, its staff and contractors from liability for loss or injury arising from participation, except where caused by our gross negligence or wilful misconduct.

9. Fitment & Installation

Where you request fitting, setup, or mechanical advice, you are responsible for safe use afterwards. Check fasteners, chain tension, tyre pressures, and safety systems before each session. Track conditions and driver inputs can change outcomes; results may vary.

10. Intellectual Property

All content on the Site (text, images, logos) is owned by TKC or our licensors. You may not copy, reproduce, or use it without permission.

11. Privacy

We handle personal information per our Privacy Policy. By using the Site or Services, you consent to that policy.

12. Limitation of Liability

To the maximum extent permitted by law, we exclude all warranties not expressly stated and limit any liability to: (a) the replacement of goods or supply of services again; or (b) the cost of doing so. Nothing in these Terms limits your ACL rights.

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., severe weather, transport disruption, supplier issues).

14. Changes to Terms

We may update these Terms at any time. The “Last updated” date indicates the latest version. Continued use of the Site/Services means you accept any changes.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of QLD courts.
